本文討論開放近用授權型態的學術文獻資源。先定義開放近用的內涵及學術文獻的範圍, 指出學術文獻的危機, 自我典藏及開放近用學刊在解決此危機的能力, 以擷取後設資料的方式, 建立網路館藏。再討論各國政府對學術文獻危機的認識, 及其因應之道; 居於經濟弱勢的發展中國家, 仍有許多近用學術文獻的選擇; 最後指出, 圖書館的回應是開放近用運動生根的開始。

1. 前言

開放近用譯自Open Access, 近用是接近使用的簡稱, 中國大陸將之譯為開放存取(李武及劉茲�� 2004)。1994年9月23日大法官解釋文釋字第364號, 藉解釋言論自由的機會, 從「人民平等接近使用傳播媒體」的角度, 將Access譯為接近使用。(大法官解釋, 1994)

開放近用本身是社會運動, 矯正智慧財產權向資本主義傾斜, 在不涉入法律改革的前提下, 藉著政治、商業、道德等訴求, 遊說著作所有權人基於本身的理念及利益, 釋放資訊本身的自由性, 藉以促進全球的發展。

開放近用的標的是資訊, 以著作所有權人為對象。在法律的規定或著作所有權人授權下, 具有下列兩種特性的資訊, 被稱為開放近用資訊: 1)免費使用; 2)著作權人事先同意該資訊被無限制地閱讀、下載、複製、共享、儲存、印製、檢索、連結、爬梳。免除近用資訊帶來的價格歧視, 也解決授權危機。(BOAI, 2002)

生物醫學界補充上述的定義(Bethesda, 2003): 1)保留部份權利, 必須署名原著者, 印本祗限少量及個人用途之用; 2)公開典藏, 將完整作品以標準的檔案格式寄存在至少一個由學術單位、學會、政府機構或其他聲譽卓著的單位支援的線上典藏機制裡, 該典藏機制必需採用開放近用、散布無限制、跨平台及長期典藏政策, 美國官方的公共醫學中心(PubMed Central)是符合此定義的公開典藏機制。

開放近用文獻有四個特性: 免費使用、事先授權、保留部份權利、公開典藏。包括依法喪失著作財產權的公有文獻、依法令必須公開的政府文獻、基於倫理應開放近用的學術文獻、使用時間及 地點受限的借閱文獻等, 不介入私領域的文獻。(毛慶禎, 2004)

無財產權的資訊稱為公有資訊。著作權法第30條規定, 著作財產權存續於著作人之生存期間及其死亡後五十年; 成為公有資訊後, 在尊重著作人格權的前提下, 任何人均可隨意使用。(著作權法, 2004)

以政府機關及其所屬機構、學校之經費或名義出版之資訊, 稱為政府資訊。基於施政需要, 政府各機關的資訊, 本身具有期望被民眾近用的特性。著作權法第9條、檔案法第22條(檔案法, 1999)、行政資訊公開辦法第4條(行政資訊公開辦法, 2001)等法令, 均指出政府應主動公開政府資訊, 供民眾近用。

學術文獻是學者專家的研究報告, 以過去的研究成果為基礎, 做更深入的 研究。學術文獻的作者接受公部門或基金會的贊助, 或領取學術單位的薪酬, 奉獻於學術研究, 不以個別學術成果謀利, 祗在乎其成果的散布性。

圖書館的印本文獻, 本來就供社會大眾免費近用, 祗要有一個圖書館典藏, 透過館際互借機制, 全球各地都可以近用。

2. 學術傳播的危機

學術文獻是開放近用運動的標的之一, 因為它的特性, 而被特別列舉出來(Suber, P. 2004)。

  1. 作者未領取報酬
  2. 學術文獻的價值在於傳播而不是謀利

圖書館界認為學術文獻的出版系統出現危機, 其緣由有三(Suber, P. 2003):

  1. 學刊價格的漲幅大於通貨膨漲速度, 圖書館預算趕不上學刊的漲幅;
  2. 新學刊的出現速度太快, 圖書館無法擁有所有的學刊;
  3. 學刊的近用被限制, 無法充份應用當代的科技傳播學術文獻;

開放近用運動與學刊的價格有密切關係, 但開放近用的推動者認為, 解決學刊的價格危機, 祗是開放近用運動的副產品之一, 不是主要目的。開放近用不但要解決學術文獻的價格危機, 也要排除學術文獻的授權危機(Hugenholtz, P. B., 2000)。

1940年代的物理學家Leo Szilard提出開放近用的模式, 開玩笑式的建議, 初入職場的科學家, 可買下一百張兌換卷, 供同道兌換其論文。

2003年10月, 德國境內主要的研究機構及若干國際性團體, 都簽署柏林宣言, 要求建立「開放近用」機制(Berlin Declaration 2003)。

開放近用是解決學術文獻危機的對策之一, 以兩種互補的策略進行(BOAI, 2002):

  1. 自我典藏(Self-Archiving) -  由著作所有權人授權的典藏機制;
  2. 開放近用學刊 - 學刊論文的授權方式符合開放近用定義

2. 自我典藏

有三種方式實現自我典藏:

  1. 置於作者的網站;
  2. 寄存於學科典藏所;
  3. 寄存於機構典藏所

自我典藏的論文, 分為兩種: 尚待同儕評閱的印前出版品(preprints)及經過同儕評閱的印後出版品(postprints), 以電子典藏所(e-prints)統稱之。

1991年8月以來,美國國家科學委員會、阿拉木圖實驗室及能源部共同推動學術資訊自由,建立的阿西檔案(arXiv.org)網站, 是最成功的自我典藏案例, 容納物理學及相關的數學、非線性科學、電腦科學與核子科學等術資訊,任何人都可以把自己的論文放上來,也可以下載其中的論文。其他學科, 尤其是人文學科領域, 對於自我典藏論文的共識, 還待建立。

Citeseer不僅典藏論文, 還對內容分析, 將相關的作品集中在一起, 以各種檔案格式傳送。

某些生物醫學領域的學刊, 歧視印前出版品, 不接受已經於網路公開的未正式發表論文, 阻礙學術知識的流通。(waiting)

    1a. 著作權

    自我典藏係以作者擁有論文的電子散布權為前提。已經把著作權轉移給出版社的論文, 不能自我典藏, 很多出版社不接受已經印前出版的論文。1980年代起, 基於幾件趨勢, 作者保留著作權漸成常態:

    1. 免費學刊增多, 該等學刊不要求作者轉移著作權;
    2. 社會瞭解著作權是造成學刊危機的主要因素之一;
    3. Stevan Harnad等人大力宣傳自我典藏的必要性;
    4. 開放近用運動已起

    學刊擁有的著作權極為有限, 多半祗有第一次發表權, 作者可以再授權給所有的使用者及其他散播者。

    作者授權的法律文件, 非常複雜, 創意授權(Creative Commons)條款符合開放近用的精神, 有效地舒解作者的煩惱。

    近年來, 出版社逐漸接受印前出版的論文, 同意作者自我典藏其論文, 作者要求時, 讓作者保留著作權。

    作者保留自由散播作品的權利, 並且需完整散播, 不得曲解內容。

    1b. 作者網站

    網際網路興起後, FTP及Gopher伺服器曾經是典藏作者論文的場所, 全球資訊網發明後, 作者更習慣在自己的網站建立電子典藏所, 不穩定是作者典藏所的最大困難, 換工作、退休、甚至死亡, 都可能讓原有的典藏所失效。相對而言, 學刊典藏所及機構典藏所的論文, 較為穩定, 容易被檢索機制及讀者擷取。

    Les Carr & Stevan Harnad發現, 作者自我典藏時, 每篇論文約費時6至10分鐘。

    1c. 學科典藏所

    1991年成立的阿西檔案(arXive), 是最成功的學科典藏所, 包括物理學、數學、非線性科學、電腦科學、定量生物學等。

    以特定機構研究人員發表的論文為主, 不以論文為限, 還包括: 技術報告及學位論文等。有些機構把電子出版社的功能納入, 出版電子書及電子學刊; 麻省理工學院於2000年開始的DSpace計畫, 是機構典藏所的範例。

    BOAI把開放近用學刊視為第二個策略。開放近用學刊讓作者保有著作權, 或要求作者採用創意共享授權。

    開放近用學刊以電子學刊為主, 對應的印本學刊仍可採用付費近用。製作完成後, 在網路散布的開放近用學刊, 其成本趨近於零。除了價格之外, 開放近用學刊也減少了各種近用控制。開放近用學刊的編輯、審稿、出版等業務, 仍需成本; 有很多經營模式, 最常見的是向作者收費, 或向機構收取會員費, 基金會捐贈, 收到補助, 機構的非現金捐贈, 以及其他附加價值。

    開放近用學刊有檢索及摘要服務, 開放近用學刊目錄(DOAJ)是最 完整的目錄。

    開放近用學刊的影 響力, 不會小於收費近用學刊。

    有幾個機構對出版及典藏開放近用學刊頗為投入:

    1. BioMed Central: 2000年成立, 營利的出版社, 現有百餘種開放近用學刊;

    2. the Public Library of Science (PLoS): 成立於2004年8月, 非營利出版社, 現有PLoS Biology、PLoS Medicine等兩種學刊, 還有三種學刊已在籌備中; 2000年時, 公共科學圖書館以公開信要求學術期刊在2001年9月底, 應在出版後六個月內, 將論文開放近用, 請求連署者不要供稿、審稿給不贊同此主張的學刊, 結果有180個國家的34,000個學者連署。沒有得到出版社正面的回應, 公共科學圖書館遂決定自行出版開放近用學刊。

    3. PubMed Central: 由美國國立醫學圖書館(National Library of Medicine)的國立生物科技資訊中心(National Center for Biotechnology Information)經營, 典藏生命科學學刊, 供社會大眾自由近用; 該等學刊的編輯政策必須符合相當標準, 才能被典藏。1999年由美國國家衛生院(National Institutes of Health)的院長 Harold Varmus創辦, 收錄內容包括印前及印後的電子出版品, 2000年修訂此政策。

    4. 牛津大學出版社學刊部: 2005年5月4日公告Oxford Open政策。作者付費2,800美元處理費, 該論文就可以立即開放近用; 作者所屬機構已訂購該學刊, 享有1,500美元的折扣價優待; 有財務困難的作者, 也可特例處理。否則, 就必須等待12個月的延遲期。

    5. 開放典藏促進會後設資料擷取協定(OAI-PMH)

    開放近用的作品散在個人典藏所、學刊典藏所、機構典藏所、開放近用學刊等地, 必須一個個系統去查, 非常不方便; 因此, 開放典藏促進會發展後設資料擷取協定(Open Archives Initiative Protocol for Metada Harvesting), 讓服務提供者(檢索系統)可以擷取資料提供者(典藏所)的後設資料, 將此資料聚集起來, 以單一的檢索機制, 即可檢索多個資料庫。第一版於2001年完成。

    密西根大學數位圖書館生產服務的OAIster服 務, 是服務提供者之一, 可擷取458個資料提供者5,272,686筆記錄的後設資料(2005年4月1日的資料), 讓使用者檢索老道明大學(Old Dominion University)的數位圖書館研究組也有一個較小型的實驗性服務, Arc; 開放引文計畫(Open Citation Project)的Citebase服務, 以引文強化搜尋的結果; 開放典藏促進會有服務提供者名 單及資料提供者名 單, 可供參考。Google及雅虎等搜尋引擎, 也對後設資料索引

    6. 政府態度及立法

    美國、英國及歐盟諸國對傳統學術出版系統展開官方調查, 對於科技醫學學刊的高價表示關切, 尤其對政府補助的研究計畫成果在這些付費學刊發表, 表達深切的關心。

    6a. 美國

    2003年, 美國眾議員Martin O. Sabo提出Public Access to Science Act, 要求由政府補助的研究計畫成果, 必須置於公共領域。(Learned Society Publisher's Comment on PLoS/Sabo, 2003/7/20)。

    2004年, 美國眾議院撥款委員會(Appropriations Committee)建議美國衛生研究院(NIH)採取措施, 收到受政府補助的研究計畫成果時, 應寄存於公共醫學中心; 接受美國衛生研究院補助的論文及研究計畫成果, 應寄存於美國公共醫學中心(PubMed Central)。

    經過討論後, 美國衛生研究院擬定計畫, 於2005年5月開始辦理, 可惜有三點讓步(National Institutes of Health, 2005):

    1. 由要求(requirement)變成請求(request), 沒有強制性;
    2. 延遲期由6個月放寬為12個月;
    3. 未採用政府的授權書, 以著作所有權人的同意為前提。

    面對出版社的12個月延遲期, 作者可以有三個選擇:
    1. 於出版之後, 在PMC以外的地方, 自我典藏全文; 80%以上的學刊都同意作者自我典藏;
    2. 要求出版社同意在PMC或其他地方典藏;
    3. 將論文在開放近用學刊出版。

    6b. 英國

    官方的Research Councils UK(RCUK)及民間的Wellcome Trust同時要求受其補助的研究計畫, 必須自2005年10月1日始, 將其成果以開放近用方式公告。

    2004年7月7日, 英國下議院科技委員會對於科學出版召開公聽會, 提出報告(Scientific Publicatons: Free for All?, PDF), 建議以政政經費補助的研究計畫成果, 必須寄存在機構典藏所, 英國各高等教育機構均應建立機構典藏所, 並由作者向政府申請撥付開放近用學刊的出版費。

    Current models for publishing science are "unsatisfactory", according to a report issued by the House of Commons' Science and Technology Committee.

    The report says the government has failed to act on the issue "in a coherent manner", and calls for radical changes in the publishing process.

    It wants publicly funded research to be made freely available online by means of archived digital information banks.

    At present, access is limited to those who can afford costly journal fees.

    These subscriptions have risen dramatically in recent years, and amount to several hundred pounds a year for some titles.

    But static or decreasing budgets for libraries mean many public reading institutions cannot afford to renew their subscriptions.

    Raising standards

    The MPs' report criticises some of the giants in scientific publishing, such as Reed Elsevier, for charging too much for their journals.

    It advises the government to consider allocating funds to universities and other organisations to create online repositories where their research can be stored, and viewed by the public free of charge.

    MPs also praised the new "open access" method of publishing, in which the costs of publication are met by the authors of the research, rather than the readers.

    This could mean greater levels of scientific literacy amongst the general public, and a career boost for those academics involved, according to Professor Ian Gibson, chairman of the committee.

    "The developing world would love this too, because they have to access this kind of scientific information as they build up their science and technology front," he told the BBC.

    Issues of concern

    However, "author pays" schemes have led to concerns that not-for-profit organisations, which rely on the revenue generated from their journal subscriptions, would struggle to keep themselves afloat.

    There are also fears that research integrity could be compromised.

    "We feel that there could be a conflict between the model that charges authors whose papers have been accepted, and the quality of material being accepted," said Arie Jongen, the chief executive officer of Science & Technology at Elsevier.

    "Potentially, you could reduce your standards, accept more papers, and get more revenue."

    But Vitek Tracz, chairman of the open-access pioneers Current Science Group, said of the report: "This is the point of no return; it is now time for the publishing model to change."
